Mr. Shumway handles a wide variety of litigation matters covering all aspects of business transactions, evictions, collection matters and real estate and construction.
Mr. Shumway has been representing both debtors and creditors in bankruptcy cases for over 20 years. He handles chapter 7, chapter 13 and chapter 11 cases. He has successfully litigated for creditors in several bankruptcy cases He represents both Creditors and Debtors.
Mr. Shumway has been helping landlords, both commercial and residential resolve problems with tenants for over 20 years.
Prior entering private practice, Mr. Shumway spent 15 years in banking. He worked in the areas of commercial lending, loan administration and problem loan workouts.
From 1985 to 1990, Mr. Shumway was Executive Vice President and Legal Counsel to Sacramento First National Bank While at the bank, Mr. Shumway advised it on a wide range of legal and lending issues, reviewed federal and state regulations and rules affecting the bank and developed instruction manuals for use by bank personnel to insure compliance with these regulations. Mr. Shumway drafted and revised the loan documentation and operations documents used by the bank.
Mr. Shumway supervised the "Special Assets" department of the bank and personally directed the collection of all delinquent loans over $50,000.00. Mr. Shumway supervised all litigation involving the bank either as plaintiff or defendant. He supervised and assisted outside counsel on litigation, receivership, foreclosure, bankruptcy and other collection matters.
Mr. Shumway has managed and negotiated the sale and lease of foreclosed properties. His responsibilities with respect to these properties included managing the property, working with local authorities to obtain or maintain permits for construction or operation, working with brokers and developers to sell the property, negotiating and arranging financing on properties, drafting sales agreements and drafting loan documents.
Mr. Shumway has been involved in drafting numerous complex sales and lease agreements for both real and personal property. He has also advised and set up several small corporations and partnerships.
Mr. Shumway taught real estate law and bankruptcy law at MTI for several years. He serves as a judge pro-tem for the Placer County Superior Court. He is a member of the Placer County Bar Association and the California Bar Association.
